{"id":31555,"date":"2023-08-31T11:30:00","date_gmt":"2023-08-31T06:00:00","guid":{"rendered":"https:\/\/idronline.org\/?post_type=article&#038;p=31555"},"modified":"2026-04-01T11:18:08","modified_gmt":"2026-04-01T05:48:08","slug":"can-india-undo-its-unjust-transition-from-coal","status":"publish","type":"article","link":"https:\/\/idronline.org\/article\/climate-emergency\/can-india-undo-its-unjust-transition-from-coal\/","title":{"rendered":"When coal mines close, give land back to original owners"},"content":{"rendered":"<?xml encoding=\"utf-8\" ?><p>When discussing the move from fossil fuels to <a href=\"https:\/\/scroll.in\/article\/1019026\/in-india-a-new-plan-aims-to-build-honourable-living-conditions-in-closed-coal-hubs\" target=\"_blank\" rel=\"noopener noreferrer\">renewable energy<\/a>, <a href=\"https:\/\/www.niti.gov.in\/sites\/default\/files\/2022-11\/Report_Just-Transition-Committee_compressed.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">government documents and reports<\/a> increasingly talk about a &lsquo;just transition&rsquo;&mdash;one that shares the cost and the benefit equitably with communities. However, such transitions take place on a continuum, and as a country, we already have a bad track record. In fact, when it comes to coal, dams, and power projects, we have many examples of precisely what an unjust transition looks like.<\/p><p>Thousands, if not <a href=\"https:\/\/books.google.co.in\/books\/about\/Can_Compensation_Prevent_Impoverishment.html?id=jX_aAAAAMAAJ&amp;redir_esc=y\" target=\"_blank\" rel=\"noopener noreferrer\">millions<\/a>, have been displaced by development projects and hundreds of villages have been <a href=\"https:\/\/www.downtoearth.org.in\/news\/mining\/chhattisgarh-village-under-demolition-for-hindalco-mine-villagers-claim-foul-play-71581\" target=\"_blank\" rel=\"noopener noreferrer\">wiped out<\/a>. In the <a href=\"http:\/\/www.mcrg.ac.in\/PP127.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">1950s<\/a>, one generation of indigenous people was displaced by the public sector units. <a href=\"https:\/\/coal.gov.in\/en\/major-statistics\/coal-mining-blocks\/captive-mining-block-previous\/caplegal\" target=\"_blank\" rel=\"noopener noreferrer\">Captive mines of private companies<\/a> have since hit the second generation too. There are inadequate records of the rehabilitation, resettlement, and relocation of those affected, especially in Chhattisgarh, Odisha, and Jharkhand.<\/p><p>For a just transition to renewable energy, we should start by addressing these historical wrongs. First, we owe reparations for them. We can shift into the first gear for climate crisis adaptation and mitigation only by correcting what we have done wrong in the past and then ensuring we don&rsquo;t repeat these mistakes.<\/p><div class=\"idron-article-in-content\" style=\"margin-bottom: 15px;\" id=\"idron-2119532541\"><a href=\"https:\/\/idronline.org\/what-is-idr-answers\/\" target=\"_blank\" aria-label=\"What is IDR Answers Page Banner\"><img src=\"https:\/\/idronline.org\/wp-content\/uploads\/2024\/09\/What-is-IDR-Answers-Page-Banner-1.png\" alt=\"What is IDR Answers Page Banner\"  srcset=\"https:\/\/idronline.org\/wp-content\/uploads\/2024\/09\/What-is-IDR-Answers-Page-Banner-1.png 1250w, https:\/\/idronline.org\/wp-content\/uploads\/2024\/09\/What-is-IDR-Answers-Page-Banner-1-300x60.png 300w, https:\/\/idronline.org\/wp-content\/uploads\/2024\/09\/What-is-IDR-Answers-Page-Banner-1-1024x205.png 1024w, https:\/\/idronline.org\/wp-content\/uploads\/2024\/09\/What-is-IDR-Answers-Page-Banner-1-150x30.png 150w, https:\/\/idronline.org\/wp-content\/uploads\/2024\/09\/What-is-IDR-Answers-Page-Banner-1-768x154.png 768w\" sizes=\"(max-width: 1250px) 100vw, 1250px\" width=\"1250\" height=\"250\"   \/><\/a><\/div><h3 class=\"wp-block-heading\" id=\"h-whose-land-is-it-anyway\">Whose land is it anyway?<\/h3><p>The <a href=\"https:\/\/blog.ipleaders.in\/the-land-acquisition-act-2013\/\" target=\"_blank\" rel=\"noopener noreferrer\">Land Acquisition Act, 2013<\/a>, states that for land acquired by private entities for development projects, the purpose of the takeover must be clearly defined and remain unaltered. It also mandates that a piece of land be returned to its original owner if it is unused for more than five years. However, these rules are <a href=\"https:\/\/www.counterview.net\/2021\/02\/land-acquisition-for-coalmining.html\" target=\"_blank\" rel=\"noopener noreferrer\">frequently flouted<\/a> as we use the outdated <a href=\"https:\/\/coal.gov.in\/sites\/default\/files\/2020-01\/CBA_Act.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Coal Bearing Areas (Acquisition and Development) Act<\/a>, 1957. This has created a trust deficit among local communities in the area. The Coal Bearing Areas Act should be realigned with the Land Acquisition Act.<\/p><p>A just transition from mining should focus on giving the land back to the communities it was originally taken from. The refill of such land is part of the legal lease agreement. It may be depleted, but land is generational wealth. The government is <a href=\"https:\/\/www.livemint.com\/industry\/energy\/cabinet-approves-policy-for-use-of-land-acquired-under-coal-bearing-areas-act-11649852349969.html\" target=\"_blank\" rel=\"noopener noreferrer\">planning to start<\/a> public&ndash;private infrastructure projects in mined-out areas. Repurposing can&rsquo;t take place between government and industry or industry and industry; it renders the meaning of the term redundant. Ideally, this land should be given back to the local municipal bodies or <a href=\"https:\/\/vikaspedia.in\/social-welfare\/community-power\/role-of-gram-sabha\/what-is-gram-sabha\" target=\"_blank\" rel=\"noopener noreferrer\">gram sabhas<\/a> that can create alternative livelihoods on these patches.<\/p><h3 class=\"wp-block-heading\" id=\"h-share-profit-with-the-affected-community\">Share profit with the affected community<\/h3><p>Whenever a development project is taken up, locals <a href=\"https:\/\/www.newindianexpress.com\/nation\/2017\/Sep\/17\/pm-modi-inaugurates-sardar-sarovar-dam-in-gujarat-1658533.html\" target=\"_blank\" rel=\"noopener noreferrer\">are promised<\/a> that it will change their lives and provide them a better livelihood. This is significant if you consider that the <a href=\"https:\/\/iforest.global\/wp-content\/uploads\/2022\/11\/Korba-Planning-a-Just-Transition-for-India_s-Biggest-Coal-and-Power-District_.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">top mining districts<\/a>&mdash;Korba, Korya, Chhatra, Dhanbad&mdash;are also the poorest or most vulnerable. These regions are strewn with unfulfilled and broken promises.<\/p><p>The <a href=\"https:\/\/mines.gov.in\/webportal\/content\/about-dmfpmkkky\" target=\"_blank\" rel=\"noopener noreferrer\">District Mineral Foundation<\/a> (DMF), set up under the <a href=\"https:\/\/prsindia.org\/billtrack\/the-mines-and-minerals-development-and-regulation-amendment-bill-2015#:~:text=The%20Mines%20and%20Minerals%20(Development%20and%20Regulation)%20Amendment%20Bill%2C%202015,-Ministry%3A&amp;text=5-,The%20Mines%20and%20Minerals%20(Development%20and%20Regulation)%20Amendment%20Bill%2C,and%20Regulation)%20Act%2C%201957.\" target=\"_blank\" rel=\"noopener noreferrer\">Mines and Minerals (Development and Regulation) (MMDR) Act, 2015<\/a>, was supposed to help share the profits of mining with the communities. It was to provide services such as drinking water supply, healthcare, and education in mining-affected areas. But it has been characterised by <a href=\"https:\/\/thewire.in\/rights\/spectacle-social-justice-dmf-fund-adivasi-areas\" target=\"_blank\" rel=\"noopener noreferrer\">rampant corruption<\/a>. In many cases, the money is <a href=\"https:\/\/www.newindianexpress.com\/states\/telangana\/2022\/feb\/15\/district-mineral-funds-underutilised-in-telangana-2419550.html\" target=\"_blank\" rel=\"noopener noreferrer\">lying unused<\/a>; in others, it is being spent on <a href=\"https:\/\/www.cseindia.org\/madhya-pradesh-spending-40-per-cent-of-district-mineral-foundation-dmf-funds-meant-for-other-priority-areas-on-construction-of-roads-says-cse-s-latest-analysis-8891\" target=\"_blank\" rel=\"noopener noreferrer\">building roads<\/a> and other infrastructure elsewhere that don&rsquo;t benefit the affected communities.<\/p><p>Most mining districts in India score <a href=\"https:\/\/www.businesstoday.in\/industry\/energy\/story\/top-mining-districts-in-jharkhand-poor-on-environmental-parameters-296399-2021-05-18\" target=\"_blank\" rel=\"noopener noreferrer\">abysmally<\/a> on development parameters and environmental and <a href=\"https:\/\/india.mongabay.com\/2020\/12\/people-living-near-mining-activities-at-increased-risk-of-diseases-says-study\/\" target=\"_blank\" rel=\"noopener noreferrer\">health<\/a> markers, despite the presence of <a href=\"https:\/\/environmentclearance.nic.in\/writereaddata\/Form-1A\/HomeLinks\/miningofminerals_10may.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">environmental impact evaluation measures<\/a> and <a href=\"https:\/\/www.legalservicesindia.com\/article\/679\/Laws-Relating-to-Mines-&amp;-Minerals-in-India.html#:~:text=Parliament%20has%20enacted%20the%20Mines,the%20Union%E2%80%9D%20in%20public%20interest.\" target=\"_blank\" rel=\"noopener noreferrer\">laws<\/a> designed to protect these communities.<\/p><div class=\"idron-content\" id=\"idron-2186748524\"><a href=\"https:\/\/idronline.org\/donate\/\" target=\"_blank\" aria-label=\"donate banner\"><img src=\"https:\/\/idronline.org\/wp-content\/uploads\/2023\/08\/Donate-banner-1.jpg\" alt=\"donate banner\"  srcset=\"https:\/\/idronline.org\/wp-content\/uploads\/2023\/08\/Donate-banner-1.jpg 1250w, https:\/\/idronline.org\/wp-content\/uploads\/2023\/08\/Donate-banner-1-300x60.jpg 300w, https:\/\/idronline.org\/wp-content\/uploads\/2023\/08\/Donate-banner-1-1024x205.jpg 1024w, https:\/\/idronline.org\/wp-content\/uploads\/2023\/08\/Donate-banner-1-150x30.jpg 150w, https:\/\/idronline.org\/wp-content\/uploads\/2023\/08\/Donate-banner-1-768x154.jpg 768w\" sizes=\"(max-width: 1250px) 100vw, 1250px\" width=\"1250\" height=\"250\"   \/><\/a><\/div><figure class=\"wp-block-image\"><a href=\"https:\/\/www.flickr.com\/photos\/adamcohn\/49388458297\/in\/album-72157711073072486\/\" target=\"_blank\" rel=\"noopener noreferrer\"><picture><source media=\"(max-width: 1366px)\" srcset=\"https:\/\/idronline.org\/wp-content\/uploads\/2023\/08\/coal-768x510.jpg\"><source media=\"(max-width: 1540px)\" srcset=\"https:\/\/idronline.org\/wp-content\/uploads\/2023\/08\/coal.jpg\"><source media=\"(max-width: 2000px)\" srcset=\"https:\/\/idronline.org\/wp-content\/uploads\/2023\/08\/coal.jpg\"><img decoding=\"async\" src=\"https:\/\/idronline.org\/wp-content\/uploads\/2023\/08\/coal.jpg\" alt=\"\" width=\"1024\" height=\"680\"><\/source><\/source><\/source><\/picture><\/a><figcaption class=\"wp-element-caption\">A just transition from mining should focus on giving the land back to the communities it was originally taken from. | Picture courtesy:  <a href=\"https:\/\/www.flickr.com\/photos\/adamcohn\/49388458297\/in\/album-72157711073072486\/\" target=\"_blank\" rel=\"noopener noreferrer\">Adam Cohn <\/a>\/ <a href=\"https:\/\/creativecommons.org\/licenses\/by-nc-nd\/2.0\/\" target=\"_blank\" rel=\"noopener noreferrer\">CC BY<\/a><\/figcaption><\/figure><h3 class=\"wp-block-heading\" id=\"h-enable-dignified-employment\">Enable dignified employment<\/h3><p>A just transition cannot be a transformation only from <a href=\"https:\/\/www.business-standard.com\/article\/b2b-connect\/making-a-transition-from-grey-to-green-infrastructure-117060200411_1.html\" target=\"_blank\" rel=\"noopener noreferrer\">grey to green<\/a>. Livelihoods and life should also get transformed in the process. The reality is that the locals are hardly fairly compensated for the projects that displace them and take away their generational wealth. In most cases, they don&rsquo;t get their <a href=\"https:\/\/www.orissapost.com\/locals-decry-no-job-scope-in-mining-firms\/\" target=\"_blank\" rel=\"noopener noreferrer\">promised employment<\/a>. Their incomes plummet and eventually they are <a href=\"https:\/\/www.indiawaterportal.org\/topics\/development-and-displacement\" target=\"_blank\" rel=\"noopener noreferrer\">pushed away<\/a> from their homes. Once displaced, they also fall off the development radar. I recently surveyed the mining areas in Chhattisgarh&rsquo;s Raigarh district and found that barely 10&ndash;15 percent of the people employed were original residents of the place.<\/p><p>Even when people do get employed, it is in exchange for their dignity. I have met people who owned 20 acres of land in their village and were hired as watchmen to stop others from entering the very land that was taken away from them. Bringing them livelihood is not just about implementing government programmes.<\/p><h3 class=\"wp-block-heading\" id=\"h-involving-communities-in-measuring-environmental-impact\">Involving communities in measuring environmental impact<\/h3><p><a href=\"https:\/\/www.cseindia.org\/understanding-eia-383\" target=\"_blank\" rel=\"noopener noreferrer\">Environment Impact Assessment (EIA)<\/a> is used to measure the economic and environmental costs and benefits of setting up a development project in an area. However, non-compliance with the benchmarks of the assessment <a href=\"https:\/\/forum.nls.ac.in\/slr-forum-blog\/in-the-belly-of-the-beast-eia-and-its-willfully-engineered-failings\/\" target=\"_blank\" rel=\"noopener noreferrer\">barely ever results<\/a> in a project being cancelled. On the contrary, <a href=\"https:\/\/www.downtoearth.org.in\/news\/forests\/eia-2020-to-give-straight-clearances-for-239-dams-73099#:~:text=Pradhan%20said%20other%20examples%20included,no%20EIA%20has%20been%20required.\" target=\"_blank\" rel=\"noopener noreferrer\">multiple amendments<\/a> have been made to the EIA rules to facilitate easy approval of power projects such as building of dams.&nbsp;<\/p><p>Further, the experts who perform the evaluation often represent the project rather than the affected community. In an ideal situation, the government should ensure that communities are involved in making decisions about their immediate environment and thus be made a part of any form of impact measurement that affects them.&nbsp;&nbsp;<\/p><h3 class=\"wp-block-heading\" id=\"h-let-gram-sabhas-exercise-their-power\">Let gram sabhas exercise their power<\/h3><p>The <a href=\"https:\/\/www.mha.gov.in\/sites\/default\/files\/PESAAct1996_0.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Panchayat Extension to Scheduled Areas (PESA) Act, 1996<\/a>, mandates that the gram sabha&rsquo;s permission be taken before setting up coal mines in and around villages. However, there have been <a href=\"https:\/\/www.amnesty.org\/en\/wp-content\/uploads\/2021\/05\/ASA2043912016ENGLISH.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">several instances<\/a> where mines were built in these villages despite resistance expressed by the villagers at these sabhas. In <a href=\"https:\/\/thewire.in\/rights\/chhattisgarh-coal-mining-hasdeo-arand\" target=\"_blank\" rel=\"noopener noreferrer\">some cases<\/a>, using the loophole that the PESA Act has not been <a href=\"https:\/\/scroll.in\/article\/988729\/25-years-on-many-indian-states-havent-implemented-the-law-that-empowers-adivasi-communities\" target=\"_blank\" rel=\"noopener noreferrer\">implemented<\/a> in various states, the government didn&rsquo;t even consider the discussions held at the sabhas before deciding the fate of the land and its people.&nbsp;<\/p><p>To ensure that community voices are taken into consideration during the energy transition process, it is important to value existing structures of local governance.&nbsp;<\/p><h3 class=\"wp-block-heading\" id=\"h-set-and-follow-environmental-norms\">Set and follow environmental norms<\/h3><p>The <a href=\"https:\/\/factly.in\/explainer-what-are-campa-funds\/\" target=\"_blank\" rel=\"noopener noreferrer\">Compensatory Afforestation Fund Management and Planning Authority (CAMPA)<\/a> was set up in 2002 to collect and divert funds for compensatory afforestation on non-forest land whenever a forest area is taken up for mining purpose. However, the fund remains <a href=\"https:\/\/scroll.in\/article\/812753\/understanding-the-compensatory-afforestation-fund-bill-and-why-it-spells-doom-for-adivasi-rights\" target=\"_blank\" rel=\"noopener noreferrer\">poorly utilised and managed<\/a> on the ground. The <a href=\"https:\/\/pib.gov.in\/PressReleasePage.aspx?PRID=1906384#:~:text=The%20Compensatory%20Afforestation%20Fund%20(CAF,of%20locally%20suitable%20plant%20species.\" target=\"_blank\" rel=\"noopener noreferrer\">Compensatory Afforestation Fund Act, 2016<\/a>, which now dictates the CAMPA fund is <a href=\"https:\/\/thewire.in\/environment\/compensatory-afforestation-fund-act-hurting-forest-communities-says-petition\" target=\"_blank\" rel=\"noopener noreferrer\">being used<\/a> to capture community lands and provide even more power to the forest department to oppress forest-dwelling communities.<\/p><p>Ecologically fragile areas should be part of the<a href=\"https:\/\/blog.forumias.com\/no-go-area-policy\/\" target=\"_blank\" rel=\"noopener noreferrer\"> no-go category<\/a> so that all projects in these areas are non-starters. However, these benchmarks keep getting <a href=\"https:\/\/www.hindustantimes.com\/india-news\/coal-blocks-within-dense-forests-find-place-in-latest-auction-list-101680633724811.html\" target=\"_blank\" rel=\"noopener noreferrer\">diluted<\/a> and we are losing a lot of green cover to new mines.<\/p><p>As a land rights activist, I am now concerned about whose land will be used for transitions to renewable energy. Even after the conversation about just transitions began, people have been alienated by <a href=\"https:\/\/www.context.news\/climate-justice\/long-read\/indias-solar-energy-boom-fuels-local-struggle-for-green-justice\" target=\"_blank\" rel=\"noopener noreferrer\">solar projects<\/a> that took over <a href=\"https:\/\/idronline.org\/ground-up-stories\/solar-plant-bears-no-fruit-why-jaisalmers-farmers-are-unhappy\/\" target=\"_blank\" rel=\"noopener noreferrer\">acres and acres<\/a> of their land, giving them paltry returns.<\/p><p>We must, at some point, ask what the benchmarks are against which the justness of energy transition will be measured. There are <a href=\"https:\/\/iforest.global\/wp-content\/uploads\/2021\/07\/Five-Rs-Single.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">120 districts<\/a> in the country that have sizeable fossil-fuel industries or fossil-fuel-dependent industries, and they house one-fourth of the country&rsquo;s population. If India truly wants to ensure a just transition, it will have to start by addressing what it did wrong in the past.
